1. Acceptance of Terms
By accessing or using QRStar ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
If you do not agree to these Terms, do not use the Service.
2. Service Description
QRStar provides a QR code generation API that allows you to:
- Generate static QR codes encoding URLs, text, or other data
- Generate dynamic QR codes with editable redirect URLs
- Track scan analytics for dynamic QR codes (location, device type, timestamps)
- Access QR code images via our CDN
The Service is provided on a pay-per-use basis. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.
3. Account Terms
Registration
- You must provide accurate and complete information when creating an account
- You must be at least 13 years old to use the Service
- You are responsible for maintaining the security of your account credentials
API Keys
- API keys are confidential and should be treated like passwords
- You are responsible for all activity that occurs using your API keys
- Notify us immediately if you believe your API key has been compromised
- Do not share API keys publicly or embed them in client-side code
4. API Usage
Rate Limits
Fair Use
You agree to use the API in a manner consistent with its intended purpose. Excessive requests, attempts to circumvent rate limits, or usage patterns that negatively impact other users may result in temporary or permanent suspension.
API Versioning
We may update or deprecate API versions. We will provide reasonable notice before discontinuing support for an API version. It is your responsibility to migrate to supported versions.
5. Pricing and Payment
Pay-Per-Use Pricing
Billing
- Payments are processed by Stripe
- Usage is metered and billed monthly
- You are responsible for paying all applicable taxes
- Failed payments may result in service suspension
Refunds
Due to the nature of our pay-per-use service, refunds are generally not provided for usage charges. If you believe you were incorrectly charged, contact us within 30 days.
Price Changes
We may change our pricing at any time. We will provide at least 30 days notice before price increases take effect. Your continued use of the Service after a price change constitutes acceptance of the new pricing.
6. Acceptable Use
You agree NOT to use the Service to:
- Generate QR codes containing illegal content or linking to illegal activities
- Distribute malware, phishing links, or other malicious content
- Engage in spam or unsolicited communications
- Infringe on intellectual property rights of others
- Collect personal data without consent
- Circumvent rate limits or abuse the Service
- Resell or redistribute the Service without authorization
- Interfere with or disrupt the Service or its infrastructure
- Violate any applicable laws or regulations
We reserve the right to investigate and take appropriate action, including suspension or termination, for any violations of this acceptable use policy.
7. Intellectual Property
Our Property
The Service, including its design, features, and code, is owned by QRStar and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding.
Your Content
You retain ownership of any content you encode in QR codes. By using the Service, you grant us a limited license to store and process your content solely to provide the Service.
Generated QR Codes
QR codes generated using our Service may be used by you for any lawful purpose. We make no claim of ownership over the QR code images themselves.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS"
We make no warranties, express or implied, regarding the Service, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not guarantee:
- That the Service will be uninterrupted or error-free
- That defects will be corrected
- That the Service is free of viruses or other harmful components
- Any specific uptime or availability level (no SLA)
- The accuracy of scan analytics data
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, QRSTAR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Termination
By You
You may stop using the Service at any time. You can delete your account through the dashboard or by contacting us. Deletion will remove your data according to our Privacy Policy.
By Us
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Reasons for termination may include:
- Violation of these Terms or our Acceptable Use Policy
- Non-payment of fees
- Fraudulent or illegal activity
- Extended periods of inactivity
Effect of Termination
Upon termination, your right to use the Service will immediately cease. Dynamic QR codes will stop redirecting. Provisions that by their nature should survive termination will survive (including limitation of liability, disclaimers, and dispute resolution).
11. Changes to Terms
We may modify these Terms at any time. We will provide notice of material changes by posting on our website or emailing you. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms.
If you disagree with changes, you must stop using the Service and delete your account.
12. General Provisions
Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
Dispute Resolution
Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action.
Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and QRStar regarding the Service.
Assignment
You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
No Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
